    • ESTATE OF THEODORE (Theodoric) CARTER
      Eliza Jane Carter, surviving wife, represents at the February 1868 term of County Courtt that her husband, Theodore Carter) died in September 1867 (Yellow fever) leaving a surviving wife and several minor children, and property; that on the 16th of October 1861, he made a Will which was filed with her petition.

      The affidavit to the witnesses signatures (French & Bennett) by R. J. Goode & Solomon Bowers, state that French, Bennett, and Carter were "for many years officers in the different offices" of Fayette County and residents and that all three "died during the prevalence of the yellow fever in the town of La Grange about the Month of September 1867. "

      35 acres of land "including the homestead" 110 acres " near Calvin Kirk", cattle, hogs, etc.,...,$ 1,700.00
      An interest in the estate of MargaretCarter (Margaret B. Carter)"believed to be abt $400.00 -$500.00; fees due "while he acted as Mayorof La Grange and ex-officio Justice Peace."

      GUARDIANSHIP OF THEODORE CARTER
      This is a case of non compos mentis of an adult
      Eliza Jane Carter represents to the Court that " her husband , Theodore Carter , is not of sound mind , that everything in the power of your petitioner has been done for his restoration , but without avail, and his insanity now has become permanent. " She asks that " a jury may be summoned to inquire into his insanity " and if found insane , that she be appt. his Gdn. Filed 18 May 1854. Dr. Barkley Townsend was summoned to give his opinion. The jury , Edward Davis , foreman , found him to be insane and that " his insanity commenced on or about April 1 , 1854

      Her bond as Gdn $4,000.00; Sureties Margaret B, Carter, Lovick P, Webb, Robert S, Carter ; 6/l/l854
      On 11/28/1854 , Carter files a petition with the Court representing that " if he was ever insane , that he has entirely recovered." He petitions the Court to set aside the previous order declaring him insane " With out any assistance or interference of his said Guardian ," and that she be relieved from further responsibility as Guardian. The Court granted his plea and revoked the order.
